美国EB-1A杰出人才移民申请流程

EB-1A outstanding talent immigration application process in the United States

.申请准备（咨询、签约、准备递案资料）；

Application preparation (consultation, signing, preparation and submission of documents)

.向移民局提交I-140申请（可以选择加急申请，15天内可以得到结果；普通审理时间为4~6个月或者 6~8个月）；

Submit the i-140 application to the immigration office (you can choose the urgent application and get the result within 15 days; General trial time is 4~6 months or 6~8 months);

.收到不同的四种结果：

You will received four differnt results:

第一种，RFE (87 days) 如果申请案件收到移民局的补件通知，移民官通常会给87天的时间准备补件材料。

First, if an application is notified by the immigration office, the immigration officer usually gives 87 days to prepare the documents.

第二种， Notice of Intent to Deny 收到移民官有意拒绝的通知(NOID)。

Second, receive a notification (NOID) from the immigration officer of a deliberate refusal.

第三种，Denied then Motion to Reopen or Refile

案件直接被移民局拒绝。

The third, Denied then Motion to Reopen the or Refile the case directly rejected by immigration.

第四种，Approval 收到批准通知。收到批准后，申请人可以分不同情况开始后续准备：

a.如果申请人在美国境内，案件批淮之后，开始办理境内转换身份，提交I-485表格。

b.如果申请人在美国境外，则经过美国国家签证中心(NVC)审理，去使领馆面签，通常中国申请人在广州领事馆面签。

Fourth, the Approval Approval is directly notified. After receiving the approval, the applicant may start the follow-up preparation in different circumstances: a. if the applicant is in the United States, after the approval of the case, the applicant shall start to transact the domestic identity conversion and submit the i-485 form. B. If the applicant is outside the United States, he/she will go through the national visa center of the United States (NVC) and go to the embassy and consulate to sign in person. Usually, the Chinese applicant will sign in person at the consulate in guangzhou.

截止2018年11月，I140获批后转I485的实际排期是一年。同时也要及时关注美国移民局官网公布的排期。

As of November 2018, the actual schedule for I140 to be transferred to I485 after approval is one year. Also keep an eye on the schedule posted on the uscis website.
