Second I-526 filed by Older Child. Several EB-5 Regional Centers accept investors age 14 or older and many accept investors age 18 or older. A child over 14 whose parents are EB-5 investors worried about their child ‘ageing out’ may file a second I-526 to guard against this possibility. In this strategy, the child has two chances to become a U.S. permanent resident – one as a dependent of the parent-investors, and one as a self-petitioning investor.
为超龄子女提交第二个526申请。部分EB-5区域中心接受14岁及以上的投资者，更多的区域中心只接受18岁及以上的投资者。如果EB-5投资者有超过14岁的子女，并担心其可能会超龄，可以让孩子作为主申请另外提交一份526申请，以防止子女超龄的可能性。用这种方法，孩子有两个机会可以成为美国永久居民 - 一个是以子女身份成为投资者的附属申请人，另一个自己是项目的投资者。

Withdrawal and refiling of a pending I-526 petition. In cases where the I-526 remains pending, an investor may withdraw and request refund of the EB-5 investment, transferring the returned funds to a child over 14 years of age, which child then files a new I-526 petition. Please note: no retention of the initial priority date is possible under current law. The child’s date of filing will be in the future and the quota delay will not be reduced for the period of time that the parents’ I-526 petition was pending. Please also note that a Regional Center or project is not obligated to refund the EB-5 investment in these circumstances.

Family-based I-130 filed by CPR parent. Once either EB-5 parent enters the U.S. and becomes a CPR, that parent can file an I-130 in the F-2B category for unmarried sons and daughters over age 21. For Chinese nationals, the F-2B category carries about a five to six year quota delay. During this period, the parent-sponsor must preserve Permanent Resident status through physical presence and income tax filings in the U.S. Once the F-2B China quota delay has passed, the son or daughter becomes an LPR.

Multinational business employment (L-1) for Older Child. For EB-5 investors who own businesses in China, employing the older child in the China company, then setting up an affiliated company in the U.S. and transferring the older child to work in the U.S. branch company may be an effective method to bring the family together in the U.S. This method can also lead to a Permanent Resident option for the child who works in a managerial or executive role in both the China and U.S. companies. This visa is known as L-1A and “multinational transferee.”

School visa (F-1) for Older Child. An older son or daughter whose family presently resides in China remains eligible for an F-1 study visa in the United States, particularly if the child’s age makes him or her ineligible to immigrate through EB-5. Most university degree programs afford graduating students a work permit for one to three years. This work period allows a student to find employers who will sponsor for job-based green cards in the U.S. This strategy also brings the family together in the U.S.
